Terms of Service
1. The provider and agreement
CONSULTMARKE LTD, trading as ConsultMarke, is based at Office 17441, 182-184 High Street North, East Ham, London E6 2JA, UK. Contact us at contact@consultmarke.com or +44 7400 753316. These terms apply when you buy a digital consulting session from us. By buying a session, you agree to them. They do not limit your legal consumer rights.
2. Scope of services
We offer personal advice on SEO, keyword research, marketing, e-commerce, social media, SaaS, branding and monetisation. Your package sets the length and scope of the session. This is not legal, tax, investment or other regulated professional advice. Implementation, advertising costs, managed campaigns and ongoing support are only included if we agree them separately in writing. We cannot promise particular search rankings, revenue, traffic or business results.
3. Booking, prices and payment
Each session is a one-time purchase, not a subscription. Prices on the Services page and at checkout are in euros (EUR). The final price is shown and charged in euros. Check the total before paying; your bank may charge conversion or other fees. Our current checkout uses Stripe; a separate PayPal checkout is not currently available. No recurring charge is authorised by a session purchase. The checkout total is the amount you agree to pay us; any required taxes must be included or clearly identified before you order. Sending an enquiry or session request doesn't confirm a booking. You need to pay successfully and agree an appointment with us. You can check and correct your package and details before selecting Pay now. Keep your payment confirmation and contact us if you haven't received scheduling details. Keep a copy of the terms that apply to your purchase.
4. Delivery by video call
Sessions take place as live, one-to-one Zoom calls at an agreed time. Give us a correct email address and make sure you have a working internet connection, a suitable device and access to Zoom. We send scheduling details to your booking email. Your session starts at the agreed time, so arriving late may leave less time for the call. We only record calls if everyone has expressly agreed beforehand. Written materials are only included if we've expressly agreed to provide them.
5. Rescheduling and cancellation
Contact us at least 24 hours before the agreed start time to cancel or reschedule. A new time depends on consultant availability and agreement between us. If you cancel in time before the call, we refund the undelivered session. If you give less than 24 hours' notice or miss the call, we normally offer another appointment rather than an automatic refund, depending on availability and the circumstances. Legal cancellation rights and remedies if we fail to deliver always take priority.
6. Cooling-off rights
Eligible consumers normally have 14 days after the day a distance service contract is entered into to cancel without giving a reason. Personalised advice delivered online is still a service, not automatically an exempt digital download. Our Consumer Cancellation page explains the procedure and provides a model form, which you do not have to use. We must not start an eligible consumer service within that period unless you expressly request it separately; otherwise we wait until the period ends. Ticking the general terms box does not waive those rights. If you cancel after asking us to start, any lawful proportionate charge must cover only the work already provided. Your cancellation right can end after the service is fully delivered only if we have obtained the express consent and acknowledgement the law requires.
7. Client responsibilities
Give us accurate information and attend at the agreed time. Make sure you have permission to share any website access, files or personal data with us. Don't send passwords, card details or sensitive personal information through the contact form. Do not use our services for unlawful conduct, deceptive claims, fake reviews, artificial engagement or infringement of another person's rights. You remain responsible for your business decisions and for putting advice into practice. We may suspend abusive or unlawful use, but we will still meet any refund obligations.
8. Confidentiality and intellectual property
We use the information you share to provide your session. We keep non-public business information confidential unless we must disclose it by law or share it with authorised service providers. You keep ownership of materials you already own. Our frameworks and materials remain ours. You may use our recommendations and delivered materials within your business. You cannot resell, publish or redistribute protected materials without permission.
9. Our cancellation or technical failure
If we can't provide a scheduled session, we'll offer another time that works for both of us or refund the undelivered service. If technical problems prevent a useful call, contact us promptly so we can look into it and arrange a replacement or refund where appropriate. Events beyond our reasonable control may mean we need to reschedule. Your legal consumer rights still apply.
10. Liability
We provide our services with reasonable care and skill. Where the law allows, our total liability for a session is limited to the amount you paid for it. We do not accept liability for indirect losses or lost business opportunities. For consumers, these limits apply only to the extent they are lawful and fair and do not reduce remedies for a failure to provide reasonable care and skill. These limits do not apply to fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability or consumer right that the law does not allow us to exclude.
11. Governing law and complaints
The laws of England and Wales govern these terms. The courts of England and Wales have jurisdiction, unless mandatory consumer rights allow you to bring a claim in your home jurisdiction. To make a complaint, email contact@consultmarke.com with your booking details and what you would like us to do. We'll review it and reply without unnecessary delay. See Company & Complaints for the process. You do not have to give up statutory remedies or payment-provider dispute rights to contact us.
12. Updates
The terms in place when you pay apply to that booking. Later changes won't affect an existing booking unless we agree otherwise. The English version is the official version. Translations are for reference, subject to any mandatory local law.
